Welcome to Shoutcheap.com. By signing up for and using our services, you agree to be bound by the following terms and conditions. These terms apply to all customers of our services. “Shoutcheap.com,” “we,” “our,” or “us” refers to the service provider. “You” or “client” refers to the person or entity using our services.

We reserve the right to update or modify these terms at any time. It is your responsibility to review this page periodically for changes.

Copyrights & Restrictions

All content on Shoutcheap.com including text, images, code, and audio is protected by copyright and is the property of Shoutcheap.com unless otherwise stated. No content may be copied, reproduced, or redistributed without our express written permission.

Streaming, Content Hosting & Licensing

You are solely responsible for the content you stream or host through our platform. Shoutcheap does not actively monitor streams. We do not provide legal coverage for the distribution of copyrighted materials. All licensing and royalty obligations are your responsibility.

You may not use our services to distribute or promote adult content, hate speech, or any illegal or unethically offensive material. If contacted by authorities regarding such content, we will cooperate fully with their investigations.

We do not provide data backups by default. Clients wishing to arrange backups must contact us for a custom plan. Data is hosted at the client’s own risk.

Streaming above your purchased bitrate may result in account suspension without notice. A $5 admin fee applies for reactivation.

Service Availability

While we aim to provide 24/7 service, occasional outages or downtime may occur. We make no guarantees of uninterrupted service.

Payment, Cancellation, and Refund Policy

All services are billed monthly or as otherwise specified. Non-payment may result in suspension and/or additional fees.

New customers are eligible for a refund only within 24 hours of initial payment, and only if the service has not been used. Setup, administrative, and processing fees are non-refundable.

Service cancellations must be submitted via our official contact methods. Canceling a PayPal subscription directly may lead to immediate termination of services.

Plan & Feature Changes

We reserve the right to modify plan features, pricing, or included services at any time. For changes that affect existing customers, we will provide at least 30 days notice via email before the change takes effect. Changes affecting prospective customers may take effect immediately.

Data Retention After Cancellation or Suspension

Upon cancellation or suspension of your account, any data associated with your services — including saved player configurations, hosted mobile pages, and uploaded files — may be permanently deleted. ShoutCheap is not responsible for recovering data after an account has been cancelled or suspended. We recommend exporting or saving any important data before cancelling your service.

Reselling

Reselling or sub-licensing ShoutCheap services, tools, or generated content — including but not limited to embed code, hosted pages, or Studio Series outputs — to third parties is strictly prohibited without prior written agreement from ShoutCheap.

Bandwidth & Server Resources

We maintain a generous bandwidth allocation per customer, but excessive usage may negatively impact server performance. We reserve the right to suspend or terminate accounts that abuse resources.

Third-Party Services

We may integrate or support third-party tools and platforms (e.g., PayPal). We are not responsible for issues related to third-party services. You agree to abide by their respective terms of service.

Player Studio

Player Studio is a feature included with your ShoutCheap hosting plan that allows you to generate embeddable radio player widgets, hosted mobile pages, and related tools. Use of Player Studio is subject to the same terms that govern your hosting service, with the following additions:

The “Powered by ShoutCheap” badge displayed on all players and hosted pages — across Entry, Standard, and Pro tiers — may not be removed, hidden, or altered in any way.
Embed code generated through Player Studio may only be used on your own websites or applications. Reselling, redistributing, or sublicensing the generated code or hosted pages to third parties is not permitted.
Hosted mobile pages published at play.shoutcheap.com (Pro tier) are tied to your active hosting account. Pages will be automatically unpublished if your account is suspended, cancelled, or downgraded to an ineligible plan.
ShoutCheap is not responsible for playback issues caused by your stream server being offline, metadata not being available from your stream source, or third-party browser or device restrictions.

MP3 Tag Studio

MP3 Tag Studio is a browser-based tool included with your ShoutCheap hosting plan that allows you to view and edit metadata tags on MP3 files. Use of MP3 Tag Studio is subject to the same terms that govern your hosting service, with the following additions:

MP3 Tag Studio processes all files entirely within your browser. Your audio files are never uploaded to or stored on ShoutCheap servers.
Metadata suggested by MP3 Tag Studio is sourced from third-party services including iTunes, MusicBrainz, and Discogs. ShoutCheap makes no guarantee of the accuracy or completeness of any suggested metadata.
You are solely responsible for ensuring that any metadata changes you apply to your files are accurate and do not infringe on the intellectual property rights of any third party.
Access to MP3 Tag Studio is tied to an active ShoutCheap hosting plan and may be suspended or removed if your account is suspended, cancelled, or otherwise ineligible.

Use of our services is also governed by our Privacy Policy. Please review it to understand how we handle your data.

DMCA Compliance

If you believe your copyrighted work is being used without permission on our platform, please send a DMCA takedown request to our designated contact email with all required legal documentation.

Governing Law

These terms are governed by the laws of the State of Florida, United States. Any disputes will be resolved in the applicable courts located in Florida.

Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, SHOUTCHEAP.COM AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DATA LOSS.

WE ARE NOT LIABLE FOR:

FAILURES CAUSED BY THIRD-PARTY SERVICES;
FAILURES TO PROVIDE SECURITY;
CONTENT PROVIDED BY YOU OR END-USERS;
INTERRUPTIONS OUTSIDE OUR CONTROL.

Severability

If any provision is deemed unenforceable, the remaining terms will remain in full force and effect.

Service Level Agreement (SLA)

Shoutcheap.com targets 99.5% uptime per calendar month, excluding scheduled maintenance and events outside our control (e.g., data center outages, force majeure). Support requests submitted through our official channels will receive an initial response within 24 business hours, with critical issues prioritized. If uptime falls below 99.0% in any given month, affected clients may request a service credit equal to 10% of their monthly fee. This SLA does not apply to clients on trial or free-tier plans.
